Ayon sa isang Youtube video na ipinost noong Hulyo 2021, wala raw kontraktwalisasyon noong panahon ni Marcos. Dagdag pa nito, nang mapaupo sa puwesto si pangulong Corazon Aquino, ipinasa raw nito ang batas para magkaroon ng contractual employees. Ito ay walang katotohanan. Administrasyon ni Marcos, hindi ni Aquino, ang nagpasimula ng kontraktwalisasyon sa Pilipinas. Nilagdaan ni Marcos noong 1974 ang Presidential Decree No. 442 o Labor Code of the Philippines na nagbigay ng probisyon para sa mga employer na gawing probationary ang kanilang mga manggagawa.
Binigyang probisyon ni Marcos sa pamamagitan ng Labor Code of the Philippines o Presidential Decree No. 442 ang pagkakaroon ng kontraktwalisasyon. Ayon sa Article 281 nito, maaaring i-terminate ang mga probationary na empleyadong hindi nakamit ang requirements sa pagiging regular. Sa isang amendment ng Labor Code, ang probationary employment ay hindi puwedeng lumagpas sa anim na buwan.
Ayon sa Article 281 ng P.D. No. 442, “Probationary employment shall not exceed six months from the date the employee started working, unless it is covered by an apprenticeship agreement stipulating a longer period. The services of an employee who has been engaged on a probationary basis may be terminated for a just cause or when he fails to qualify as a regular employee in accordance with reasonable standards made known by the employer to the employee at the time of his engagement. An employee who is allowed to work after a probationary period shall be considered a regular employee.”
